Intellectual property and entertainment

Intellectual property is the collective term for rights to creative creations such as games, music, software, designs, websites, trademarks, models, inventions, development of plant varieties and, in certain circumstances, know-how. In addition, it includes (the exploitation of) image rights.

Aron Das Gupta specialises in trademark, copyright, design, database and trade name law and have expertise in related areas of law such as ICT, new media, entertainment, press law, unfair competition and greenwashing. His practice focuses on protection of investments as well as defence against claims. This includes drafting (licensing) contracts or other exploitation models, but also litigating against infringers and/or defending against allegations, both nationally and internationally. Always, the client’s (economic) interests come first.

Commercial contracts

Aron Das Gupta advises and litigates on behalf of companies and organisations in the field of commercial contracts such as agency, franchise and distribution agreements, purchase/sales agreements (including general terms and conditions, sourcing and framework agreements), licensing agreements, non-disclosure agreements, know-how protection, business service agreements and cooperation agreements.

Litigation

Initiating – and preventing – civil and arbitration proceedings is our daily work. We offer our clients a clear, transparent and practical strategy in case of a (potential) dispute. We have experience in summary proceedings (injunctive relief) and proceedings on the merits before the courts in first instance, appeal courts and various arbitration institutes and before various Benelux and European bodies. In cross-border matters, we cooperate with or refer to peers in our network.
